1. Introduction
This California Flood Insurance Services website (referred to as “website”, “site”, or “platform”) is owned and operated by California Flood Insurance Services from the United States.
Throughout the platform, the terms “we”, “us” and “our” refer to California Flood Insurance Services. We offer this website including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our platform and/or when purchasing any of our product or service, you (“User” or “Client”) engage in our “Service” and agree to be bound by the following terms and conditions/terms of use (“Terms”), including those additional terms and policies referenced herein and/or available by hyperlink. These Terms and Conditions apply to all users of the site, including without limitation users who are browsers, clients, and/or contributors of content.

2A. No Insurance Coverage Created
Quotes, premium indications, coverage summaries, and other information provided through the Site are for informational purposes only and do not constitute an insurance policy, binder of coverage, or guarantee of insurability. No insurance coverage is in effect unless and until coverage is confirmed in writing by an authorized representative and accepted by the issuing insurance carrier, and any required premium has been received and accepted.
California Flood Insurance Services is an insurance agency and not an insurance carrier. Insurance policies are issued by third-party insurance companies. We do not underwrite risks and we do not guarantee acceptance, pricing, coverage scope, or eligibility decisions made by any insurer.
2B. Premium Payments and Financing
Premium payments submitted through the Site or through our representatives are subject to final acceptance and processing by the applicable insurance carrier or premium finance company. Coverage may be delayed, declined, cancelled, or rescinded if payment is rejected, reversed, financed and later defaulted, or otherwise not successfully completed.
If premium financing is used, additional terms and conditions from the premium finance company will apply. Failure to make required installment payments may result in policy cancellation and returned commissions where permitted by law or agreement.
3. Eligibility
3.1 Age Requirement: The use of California Flood Insurance Services website and services is limited to individuals who are at least 18 years old. By accessing or using the platform, you represent and warrant that you are 18 years of age or older. If you are under the age of 18, you may only use the platform with the consent and supervision of a parent or legal guardian.

You may not: (a) resell or make any commercial use of this Site and Services or any of the contents of this platform; (b) modify, adapt, translate, reverse engineer, decompile, disassemble or convert any of the contents of this Site not intended to be so read; (c) copy, imitate, mirror, reproduce, distribute, publish, download, display, perform, post or transmit any of the contents of this Site in any form or by any means; or (d) use any data mining, bots, spiders, automated tools or similar data gathering and extraction methods on the contents of the Site or to collect any information from the Site or any other user of the Site.

California Flood Insurance Services is not responsible for any errors or delays in responding to any inquiry or request caused by any outdated or incorrect information provided by you or any technical problems beyond the control of California Flood Insurance Services.
Information Accuracy: You agree that all information you submit through quote forms, applications, account registrations, or other communications is true, complete, and accurate to the best of your knowledge. Misstatements, omissions, or inaccuracies may result in changes in premium, denial of a claim, cancellation of coverage, or rescission of a policy by the insurance carrier. You are responsible for reviewing all submitted information and notifying us promptly of any corrections.
7. Intellectual Property Rights
Your use of the platform and its contents grants no rights to you concerning any copyright, designs, and trademarks and all other intellectual property and material rights mentioned, displayed, or relating to the Content (defined below) on the Site. All Content, including third party trademarks, designs, and related intellectual property rights mentioned or displayed on this Site, are protected by national intellectual property and other laws. Any unauthorized reproduction, redistribution or other use of the Content is prohibited and may result in civil and criminal penalties. California Flood Insurance Services has no obligation to monitor this platform or any portion thereof. However, we reserve the right to review any posted content and remove, delete, redact or otherwise modify such content, in our sole discretion, at any time and from time to time, without notice or further obligation to you. California Flood Insurance Services has no obligation to display or post any content.
9. Digital Millennium Copyright Act
California Flood Insurance Services expects all users to respect the intellectual property rights of others. California Flood Insurance Services may remove material that appears in its sole discretion to infringe upon the intellectual property rights of others and we will terminate the access rights of any repeat infringer. If you are a copyright owner or an agent thereof and believe that any Content infringes upon your copyrights, you may notify us at service@californiafloodinsurance.com. The notification must include the following information: physical or electronic signature of the owner or authorized agent of the owner of the allegedly infringed work; identification of the allegedly infringed work; identification of the material that is claimed to be infringing and reasonably sufficient information for California Flood Insurance Services to locate the material; contact information of the notifying party, such as an address, telephone number, and email; a statement that the notifying party has a good faith belief that the use of the material in the manner complained of is not authorized by the owner of the allegedly infringed work, its agent or the law; and a statement, under penalty of perjury that the information in the notification is accurate and the notifying party is the owner or authorized agent of the allegedly infringed work.
10. SMS and Text Messaging Terms
10.1 Consent to Receive SMS Messages: By providing your mobile phone number on our online quote form, application, or other medium, and clicking “Continue” or otherwise submitting the form, you expressly consent to receive SMS/text messages from California Flood Insurance Services. You understand and agree that:
- This consent applies to automated and non-automated text messages
- Consent is not a condition of purchasing any goods or services
- You may still obtain quotes and services from us without providing SMS consent
- Your consent is being provided to California Flood Insurance Services specifically
10.2 Types of Messages: The SMS messages you may receive include, but are not limited to:

10.7 How to Opt-Out: You may opt-out of receiving SMS messages at any time by:
- Replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any SMS message you receive from us

- Calling our customer service line during business hours
After you opt-out, you will receive a final confirmation message. Please note that opting out of marketing messages will not affect transactional or account-related messages that are necessary for your service.

TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, CALIFORNIA FLOOD INSURANCE SERVICES EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES AND REPRESENTATIONS, EXPRESS OR IMPLIED, INCLUDING ANY (A) WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USE AS TO THE SITE AND ITS CONTENT, INCLUDING THE INFORMATION, DATA, SOFTWARE, OR PRODUCTS CONTAINED THEREIN, OR THE RESULTS OBTAINED BY THEIR USE OR AS TO THE PERFORMANCE THEREOF, (B) WARRANTIES OR CONDITIONS ARISING THROUGH COURSE OF DEALING, AND (C) WARRANTIES OR CONDITIONS OF UNINTERRUPTED OR ERROR-FREE ACCESS OR USE. THE SITE AND ALL CONTENTS THEREIN AND COMPONENTS THEREOF ARE PROVIDED ON AN “AS IS” BASIS AND YOUR USE OF THE SITE IS AT YOUR OWN RISK.
CALIFORNIA FLOOD INSURANCE SERVICES DOES NOT WARRANT THAT THE SITE WILL BE AVAILABLE, ACCESSIBLE, UNINTERRUPTED, TIMELY, SECURE, ACCURATE, COMPLETE, OR ERROR-FREE. WE DO NOT WARRANT THAT DEFECTS WILL BE CORRECTED OR THAT THE SITE OR THE SERVERS THAT MAKE THE SITE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
12A. Rating, Quoting, and Content Errors
While we strive for accuracy, the Site and Services may contain typographical errors, calculation errors, rating errors, mapping errors, coverage description errors, or other inaccuracies. We reserve the right to correct any errors or omissions at any time without prior notice.
All quotes, premiums, and coverage descriptions are subject to verification and confirmation by the issuing insurance carrier. Final terms, conditions, and premiums are determined solely by the carrier and reflected in the issued policy documents.
12B. Third-Party Data Sources
The Site and our quoting tools may rely on third-party data sources, models, maps, reports, and databases, including but not limited to property data, flood zone data, hazard scores, geolocation tools, and valuation estimates. We do not control and do not guarantee the accuracy, completeness, or timeliness of third-party data.
You acknowledge that discrepancies or errors in third-party data may affect quotes, eligibility, or coverage terms. Final underwriting and coverage determinations are made by the insurance carrier based on its own standards and verification.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CALIFORNIA FLOOD INSURANCE SERVICES SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, SPECIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SITE, THE SERVICES, OR THESE TERMS AND CONDITIONS. THIS LIMITATION OF LIABILITY APPLIES EVEN IF YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE AND REGARDLESS OF THE LEGAL BASIS OF THE CLAIM, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE.
This limitation of liability includes, but is not limited to:
(i) Errors, mistakes, or inaccuracies in any Content, and any loss or damage incurred by you as a result of your use or reliance on the Content.
(ii) Transmission of bugs, viruses, Trojan horses, or similar harmful elements that may infect your equipment, as well as mechanical or electronic equipment failures.
(iii) Unauthorized access to or use of the Site or our secure servers, including any personal or financial information stored therein.
(iv) Theft, operator errors, strikes, labor problems, or any force majeure events.
(v) Loss of profits, revenue, data, or business opportunities.

IN NO EVENT SHALL THE TOTAL LIABILITY OF CALIFORNIA FLOOD INSURANCE SERVICES EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING THE SITE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED DOLLARS ($100).
Please note that certain jurisdictions may not allow the exclusion or limitation of liability for certain types of damages. If any such laws apply to you, our liability shall be limited to the fullest extent permitted by law.
14. Indemnification
You agree to indemnify, defend, and hold harmless California Flood Insurance Services and its subsidiaries, affiliates, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys’ fees and court costs) arising out of or relating to:
(a) Your use or misuse of the Site or Services;
(b) Your breach of these Terms and Conditions or any applicable law or regulation;
(c) Your violation of any third-party rights, including intellectual property rights, privacy rights, or property rights;
(d) Any content you submit, post, or transmit through the Site;
(e) Your negligence or willful misconduct.
This indemnification obligation will survive the termination of these Terms and Conditions and your use of the Site.
15. Governing Law and Jurisdiction
15.1 Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
15.2 Jurisdiction: Subject to the arbitration provisions in Section 16 below, you hereby irrevocably consent to the exclusive jurisdiction and venue of the state and federal courts located in San Diego County, California, for any legal proceedings arising out of or relating to these Terms and Conditions or your use of the Site.
15.3 Waiver of Jury Trial: TO THE EXTENT PERMITTED BY LAW, YOU AND CALIFORNIA FLOOD INSURANCE SERVICES WAIVE ANY RIGHT TO A JURY TRIAL IN ANY PROCEEDING ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE.
16. Dispute Resolution and Arbitration
16.1 Informal Resolution: In the event of any dispute, claim, or controversy arising out of or relating to these Terms and Conditions or your use of the Site (“Dispute”), you and California Flood Insurance Services agree to first attempt to resolve the Dispute informally by contacting us at service@californiafloodinsurance.com. We will attempt to resolve the Dispute through good-faith negotiations for a period of at least thirty (30) days.
16.2 Binding Arbitration: If the Dispute cannot be resolved through informal negotiations, you and California Flood Insurance Services agree that any Dispute will be resolved exclusively through binding arbitration, rather than in court, except that either party may seek injunctive or other equitable relief in court to protect intellectual property rights or confidential information.
16.3 Arbitration Procedures: The arbitration shall be conducted in accordance with the Commercial Arbitration Rules of the American Arbitration Association (“AAA”) then in effect. The arbitration shall be conducted in San Diego, California, or at another mutually agreeable location. The arbitration shall be conducted in the English language by a single arbitrator selected in accordance with AAA rules.
16.4 Arbitration Costs: Each party shall bear its own costs and expenses associated with the arbitration proceedings, including its own attorneys’ fees. The arbitrator’s fees and administrative costs of arbitration shall be divided equally between the parties unless the arbitrator determines that such allocation would be unjust.
16.5 Arbitrator’s Decision: The decision rendered by the arbitrator shall be final and binding on the parties, and judgment on the arbitration award may be entered in any court having jurisdiction thereof.
16.6 Class Action Waiver: YOU AND CALIFORNIA FLOOD INSURANCE SERVICES AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. UNLESS BOTH YOU AND CALIFORNIA FLOOD INSURANCE SERVICES AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN THE CLAIMS OF OTHER PERSONS OR PARTIES WHO MAY BE SIMILARLY SITUATED.
16.7 Exceptions to Arbitration: Notwithstanding the above, either party may bring a lawsuit in court in the following limited circumstances:
(a) To enforce or protect intellectual property rights;
(b) To seek injunctive or other equitable relief for violations of these Terms;
(c) Claims that fall within the jurisdiction of small claims court.
16.8 California Residents: If you are a California resident, you may have the right to opt-out of arbitration. You may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by contacting them in writing or by telephone.
17. Children’s Privacy
17.1 Age Restriction: Our Site and Services are not intended for use by individuals under the age of 18. If you are under 18 years of age, you must have your parent’s or legal guardian’s permission to use the Site. By using or engaging with the Site, you acknowledge and agree that you are permitted by your jurisdiction’s applicable law to use and/or engage with the Site.

23. Assignment
California Flood Insurance Services may assign, transfer, or subcontract our rights and obligations under these Terms without your consent or notice to you, including in connection with a merger, acquisition, corporate reorganization, or sale of assets.
You may not assign, transfer, or delegate any of your rights or obligations under these Terms without our prior written consent. Any attempted assignment in violation of this provision shall be null and void.
These Terms shall be binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.
24. Waiver
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition. California Flood Insurance Services’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
Any waiver must be in writing and signed by an authorized representative of California Flood Insurance Services to be effective.
25. Force Majeure
California Flood Insurance Services shall not be liable for any delay or failure to perform any obligation under these Terms where the delay or failure results from any cause beyond our reasonable control, including but not limited to:
- Acts of God, natural disasters, extreme weather, earthquakes, floods, or fires;
- War, terrorism, riots, civil unrest, or acts of war;
- Government orders, laws, regulations, or actions;
- Epidemics, pandemics, or public health emergencies;
- Labor disputes, strikes, or lockouts;
- Internet service provider failures, telecommunications failures, or utility failures;
- Denial of service attacks, viruses, or other malicious software;
- Defects or delays in services by third-party suppliers or vendors due to circumstances beyond our control.
In the event of a force majeure, our obligations shall be suspended for the duration of the event. We will make reasonable efforts to minimize the impact and resume normal operations as soon as practicable.
26. Entire Agreement
These Terms and Conditions, together with our Privacy Policy and any other legal notices or agreements published by us on the Site, constitute the entire agreement between you and California Flood Insurance Services concerning your use of the Site and Services. These Terms supersede all prior or contemporaneous communications, proposals, agreements, and understandings, whether electronic, oral, or written, between you and California Flood Insurance Services with respect to the Site.
A printed version of these Terms and Conditions and any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
Any rights not expressly granted herein are reserved by California Flood Insurance Services.
27. Term and Termination
27.1 Effective Date: This agreement becomes effective on the date that you first access the Site or Services and remains in effect until terminated in accordance with these Terms.
27.2 Termination by You: You may terminate this agreement at any time by discontinuing use of the Site and Services and, if applicable, deleting your account.
27.3 Termination by Us: We may terminate or suspend your access to the Site and Services immediately, without prior notice or liability, for any reason, including but not limited to:
- Violation of these Terms and Conditions;
- Suspected fraudulent, abusive, or illegal activity;
- Extended period of inactivity;
- Request by law enforcement or other government agencies;
- Unexpected technical issues or problems;
- Our decision to discontinue providing the Site or Services.
27.4 Effect of Termination: Upon termination of this agreement:
- Your right to use the Site and Services shall immediately cease;
- We may delete your account and all related information and files;
- You will remain liable for all obligations incurred prior to termination;
- All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: ownership provisions, warranty disclaimers, indemnification, limitations of liability, dispute resolution, and arbitration provisions.
27.5 No Refunds: Unless otherwise required by law, termination of your access to the Site or Services does not entitle you to any refund of fees paid.
